The Ontario small claims court can hears lawsuits that claim $35,000 or less. Prior to taking any action for a client in a small claims matter, I conduct a legal assessment to ensure that it is appropriate for the matter to proceed in the Ontario small claims court. Sometimes legal action is not the most cost-effective recourse, I wish to provide the client with the most effective means to move forward.
Filing a claim
If legal recourse is the best course of action, I start with a demand letter sent to the opposing party. I try to resolve every matter prior to proceeding with any legal action. If the dispute cannot be resolved, preparing and filing a claim is the next step. From here I am with the client every step of the way through the judicial process: settlement conference and trial.
defending a claim
When a claim is brought against you for breach or contract or tort damages. I will vigorously defend the action brought against you. From answering the plaintiff’s claim by filling a defence, threw settlement conference negotiations to trial if need be. I am here to work with you, the client in resolving this matter in a timely and cost efficient manner.
DEFENDANTS claim
As a defendant, you can also make a claim of your own against the plaintiff or someone else. This is called a defendant’s claim. The process is similar to that of a plaintiff’s claim and I will be there every step of the way for clients. From defending against the claim brought against them to filling the defendants claim and the process associated.
